Man takes out mailbox, runs into house in alleged DUI

Oklahoma police report that a man was detained on suspicion of DUI after crashing into a Duncan house in the early hours of June 2. After running a stop sign, the 24-year-old driver's SUV allegedly struck a Chisholm Corner convenience store safety barrier and a mailbox before crashing into a home on North B Street around 3:15 a.m. The driver reported suffering no injuries.

The man was charged with DUI and reckless driving; he was transported to the Stephens County Jail, according to police. Police said that the SUV involved in the accident belonged to a resident of Marlow. This incident was compared to a March 27 crash in which a Duncan man reported taking pain medication before driving. He was charged with driving under the influence after hitting several objects before also crashing into a home.

Penalties for DUI in Oklahoma vary based on whether the offender has any previous DUI convictions. Penalties for even a first offense include up to a year of jail time, fines of up to $1,000 and a driver's license suspension. A DUI conviction can also result in substantial negative impacts on the offender's personal life and professional standing. The driver in this case may wish to hire a criminal defense lawyer to navigate his trial.

A criminal defense attorney attempting to build a defense in this case might attempt to cast doubt on the results of any BAC testing performed on the defendant; breath tests have greater margins of error than blood tests, and the margin of error increases as the BAC increases.
