Man is charged with DUI after falling asleep at wheel

Some readers from Oklahoma may have heard about the 36-year-old man recently detained on suspicion of DUI in Florida; the incident happened in Deltona around 12:30 a.m. on Monday, March 31. A witness says that they called police after seeing the driver asleep in his car at the intersection of Courtland Boulevard and Doyle Road. The defendant was said to have been still holding a half-eaten burrito from Taco Bell when officers found him unconscious.

Deputies say that they knocked on the defendant's window for at least 10 minutes before electing to break it. However, he was still unable to be woken after the window was broken. Deputies had to performed sternal rubs on the defendant for several minutes before he finally regained consciousness.

The defendant was asked to submit to two separate breath tests, the results of which measured his BAC at .173 and .177 percent, respectively. He was then taken into custody and charged with driving under the influence of alcohol.

Breath alcohol tests may not be completely reliable in all circumstances. Certain medical and environmental conditions may adversely influence the result and lead to an erroneous reading that can cause someone to be mistakenly accused of DUI. In addition, the fact that the defendant in this case proved so difficult to awaken could be indicative of an underlying medical condition rather than intoxication.

Someone who is convicted of DUI may face a variety of penalties, including jail time, license suspension and more. Such convictions can also sometimes follow the accused throughout the remainder of their life and adversely affect their future employment prospects. As such, DUI defendants might benefit from the assistance of an attorney who can advocate on their behalf and work to minimize the severity of their sentence as much as possible.
