Oklahoma City accident results in DUI complaint

Oklahoma City Police took a driver into custody on suspicion of DUI after a pickup truck collided with the rear of a semi-truck early on June 9. Police report that the truck was moving south on the Broadway Extension service road when the accident occurred. Near the intersection of Kelley Avenue and 122nd Street, the pickup truck slammed into the back of a parked semi-truck.

The accident occurred slightly before 5:30 a.m., and the Broadway Extension service road was closed for several hours to allow for a full police investigation. Both the driver and the passenger of the pickup truck were rushed to the hospital for treatment. While the semi-truck driver was not injured, the driver of the pickup truck suffered a broken ankle. The pickup's passenger was listed in critical condition.

Once the pickup driver was released from the hospital, he was booked into the Oklahoma City jail with $5,500 bail. Police charged him with driving under the influence with great bodily injury. This kind of DUI charge will likely lead to increased penalties if the driver is convicted, even if it is his first such charge. Even with no aggravating factors, a person's first DUI conviction can lead to a driver's license suspension, more than $1,000 in fines and fees and up to a hear in jail.

When a driver suspected of DUI is immediately hospitalized, it is unlikely that law enforcement officers were able to administer field sobriety tests. As a result, any DUI charge is likely to be based on a chemical test of the driver's blood done at the hospital. However, if the blood was tested in violation of the driver's Fourth Amendment rights, the court may not allow the results to be presented as evidence of intoxication.
